I feel like crap right now. This weekend I decided to take a road trip with my brother to San Francisco to hang out with friends and check out SF State, where I was recently accepted. Unfortunately, our trip was cut short because my ******* boss decided to schedule a "busser meeting" this weekend. I left at 7am this morning, which sucked because we were up to 3am last night, and did the drive. We got stuck in traffic for hours, and I was super anxious to get back up to Truckee so I was trying to maintain steady pace so I didnt miss it. About 10 mins north of Auburn, a CHP pulled me over, and wrote me a ticket for 83 in a 65. :pissed: GOD DAMNIT! This is number 3 for me, so I think I'm kinda ****ed! This was my first ticket in my Impreza though. I dont really know what to do. I was considering taking it to court and arguing it, but I'm not sure. I pay for my insurance which is already pretty high, so I know the consequences of **** like this. Am I considered a "negligent driver" now?
CN: 3rd ticket, in 5 days I'm 18, what should I do?
What should I do DI?
and I know, from now on I will keep the speed to the dirt!

no he means that he turns 18 in 5 days.. this is what you do.. i have lost my licence 2 times and had over 30 tickets since i was 17.. get a traffic atourney outside of the court system, they are like $100..in cali, maybe $150, they will work there magic and drop it to like a faulty speedo.. like not even a point ticket and it will be all good.. just your looking at the lawyer fee..and the ticket fee. but it will save your a*s and drive slower haha..orrr invest in a radar/laser detector, haha for some reason no one had them in cali

has it been 18 months since your last ticket? go to traffic school.
otherwise, go to court, and hope the cop doesn't show up. Or do trial by written letter, and hope the cop doesn't write one too (or hope you can write better than the cop).
at this point, that's you're only choice. good luck. I'm actually typing this on my brothers couch in Truckee right now....

i just faught a ticket for 80 in a 65 in NH and won basically if u want to fight it just do ur homework write down everything that happened determine if there is any grounds to fight upon and prepair our case well ahead of time!!! im guessing there is no way to make a plea bargan with the cop because ofthe 3 tickets under 18 years old......which is wat happened to me that would have been my 3rd and several written warnings!!!
i never took any of them that serious before but once i won that ticket i realized that dam its time to slow down i cant afford to loose my licence. in NH any ticket uner 21 ur suposed to lose it for 20 days and more for everyone after that....the first to i got away wih not losing my licence by taking defensive driving courses. but there was no way to get out of this one! so now i just go no more that 10mph over the limit and leave plenty of time just incase of traffic i figure i have just over a year untill my record stats over then i can fu(k around wihtout lossing my licence and thats well worth the wait

Thanks for everyones advice. I really don't think I have any thing to fight on the ticket, I have a radar detector, it did not go off. I looked in my rear mirror, and there was a cop with lights on so I really don't know, but I think 83 sounds pretty legit.
This is a really sh*tty situation, so thanks for all your help.

ask the court for the cop to write a supporting deposition and give you their last calibration date, in NY their equipment needs to be calibrated every month and they usually do it every 6. now you have to research the law in your state and get a good lawyer

By equipment do you mean there speedometer or their radar?

Keep in mind that it might not have been radar that caught you. There are other methods of checking your speed. Also just because your radar detector didn't see anything doesn't mean you weren't hit with radar. Cops use all kinds of new technology to catch your speed.
Your best bet is to just see if a traffic attorney can help ya and stop speeding.

and coincidentally I had a lame ass ticket going thru the mountains right before Truckee on my way back to Wyoming from seein my family up in corning and Ill be damned if snow chains arent required on your car in a chain control situation and " I dont care where your from, Wyoming or not and I dont care how often you drive in the snow, your still gonna follow our laws well your in my state"...and yes the cop actually said those words to me when I tried to argue about where I was from and that snow is no big deal for me to drive in...I'll never forget that ticket or the as*hole swine that tried to put me in my place...nothing personal guys but the CHP can go get f***ed in my Opinion

Damn that sucks about the 3rd speeding ticket. I find its difficult to fight tickets when its just a blatent speeding ticket. I was able to fight and beat an emissions ticket on my other car because the mod in question was in fact CARB exempt. talk about a PITA though.
You have nothing to lose by doing your homework and trying to contest it.

And they say that cops arent supposed to be biased in any way...yeah right, thats why statisticly speaking red cars, and bright colored vehicles in general average more tickets than any others...I know my poor Anakin and I get plenty of unwanted attention here in Wyoming, these awful hired geeks here love me to death, its like they can sense the second Ive had a headlight out or my registrations 3 days overdue, literally. Wyomings finest always seems to frown on me and Anakin, lol we dont really fit in too well with all of the big trucks and SUV's runnin around this loathesome place...

The ticket sucks but what did you expect him to say? "Oh.. then fair enough, since you say snow is no big deal for you, I'll let you go despite the fact you were breaking the law". You'd have been much much better off with "oh man, sorry about that, I'm from out of state and our chain control laws are different back home."
I agree though, being singled out sucks. It used to happen to me all the time, I got pulled over tons of times (usually for no reason) when I was a long-haired punkass teenager :D Price you pay for being different I guess.

i think everyone read that wrong...he didn't get 3 tickets in 5 days. He's under 18....this is his third ticket. AND, in 5 more days, he'll turn 18. ;)

in case the link ^^ does not work it's TicketAssassin.com - worked for me once, did not work for my wife, then it did work for a good friend of mine - they claim 70+% success and I guess so far I am at 66% but anyway - you donate $25 (or at least that is what is was when I donated) to them and they give you 'template' letters specifically written for your California Peniel (sp?) code listed on the ticket - the whole thing works due to a little known law on the CA DMV books that allows you to fight any traffic ticket through the mail.. very few people use it and the law enforcement people need to respond in writing to the court and thats a lot of extra work (the assassin people claim that the police get overtime to go to court but get nothing to respond to the court in writing ??) so anyway, log on, follow the instructions and good luck - oh, and slow down + be very respectful when stopped even if you are totally in the right - it will help in the long run - we are all driving vehicles that tend to stand out in the crowd and that is not always good ;)
**edit - I probably should mention that you need to send in the 'bail' with your request to fight the ticket through the mail so in my case I mailed them $225 or so, then 3 months later when the case got dismissed I got a check back from the state... kinda cool really (at least for me)

+1, I've gotten out of two tickets this way.....upwards of $500 back. One was just earlier this year (from my road trip up to Portland for rally school). You do have to have a decent argument, I made a good case for profiling (included photos of my car).
I'm also doing it for a video traffic/right turn on red stop sign ticket. I'll get $381 back if this works again :D
true Jon.. and the better you can make the story sound the better chance you have of getting the ticket dropped... 'the old baffle them with BS'
I sent multiple pictures of the crime scene.. including how light traffic normally was at this time of day & my explanation was a full typed page long ;) - in fact it sounded so good I kept a copy for next time..

This sounds pretty interesting, but I don't know that I would have anything to really argue against. maybe the profiling thing, but my car isnt THAT unique or anything. the only thing I could think of would be the manner in which he obtained my speed. If this method doesnt work, can I still get an attorney, got to court and make a case?

LoL!! I didnt actually mean to get all nasty with the guy, it was like 2 in the morning when I got stopped for going right through the chain control and I unfortunately didnt have my Subie yet, and he more less sneered at the fact that I was from Wyoming so I got kinda rude and started arguing for the sake of pissing the guy off because I knew there was no way he was going to not write me a ticket. I wish Id have at least thought of some better ground to argue on but that was all I came up with at he time...and for the record we dont really have any really enforced chanin control here, I mean I know we have snow chain laws,but they arent enforced here because like I tried to explain to my CHP swine that got me, the folks here are generally used to driving in it since its just a part of everyday lie here for about 8-9 months of the year

i have 32 tickets... thousands spent on them... lost my license 2 times, i have had 3 lawyers, i and i didnt have a license for a time period of 2 years if you put them together.. time spent not driving while suspended... 10 days lol

Update: Still haven't received anything from the Roseville courts. I did find out recently that my second ticket (62 in a 45) may be BS. This ticket was on a road called Glenshire Drive, and according to my friends dad, a retired CHP, Truckee PD is NOT allowed to use radar on this road. It was because of some long standing disputes over whether or not to make the speed limit 55 or 45. My question is can I argue my second ticket somehow? I didn't fight it at all, I just paid bail and was done with it, but I really want to do all I can to save on insurance, and if that means fighting a ticket from last summer, then I'm willing to do whatever I can. Suggestions?

i generally know that in indiana (not from experience, but from other's experience) that the speeding tickets they give are vary rarely put on your record. i think the reason is because you really need a car in that state, everything is so far away that if they actually enforced things or did them properly, the state would go bankrupt from people not being able to drive to work.
but generally, you never verbally fight or argue your way out whilst being pulled over in a car. the police generally have the last word almost all the time. you just say ok, i'll take the ticket or if they feel generous - they don't give you one. but the place to fight it is court. most police won't take the time to go to court and fight it, even if they do they're usually ill prepared and will lose. remember, they write like 15 or more tickets a day, and probably won't remember that one ticket they gave you so why should they show up? if you can, fight it in court or through the mail.
not saying anyone should really try this without a really good working knowledge of how to talk to police and the language to use. but my dad got out of many tickets just by arguing with the police right where he was (being pulled over), one of the ways he got out (i remember it clearly) the police were following him very close and he just slammed his brakes, the police then used the lights and told him he was speeding. he then said, "i wasn't speeding, and you were following way too close, why were you following me that close? there's no reason to follow me that close". officer replied, "i wasn't following you that close'. dad replied "yes you were, i could see the defraction pattern in your headlights in my mirrour". that was probably the single most funny moment because the police just said "well i'll give you a warning, but slow down next time", essentially, putting his tail between his legs and whining as he walked away.
now this isn't something everyone can try, he was actually deputised at one point, had no fear of police, very strong voice, didn't take BS at all, and somewhat older, so those things were very much in his favour. of course my mum told me that he had many tickets when he was younger. so this doesn't work all the time, and you should probably pick your battles wisely, but just realise that if you're going to experiment with this, 1. know what you're talking about, 2. show no fear, and 3. be prepared to pay a price for a few practice sessions with them (as in a ticket or two).
a slightly related bit of info-
I lost my CA drivers lic. a month ago while paintballing (its a long story in itself...) and went to the DMV to get it replaced. after waiting 25 minutes the DMV woman calls me up and I give her all my info, etc... she punches it all in and says 'did you ever live in Vermont?'... um, yeah but I left in 1983. well, she says - all DMVs are now connected on a national data base and we are finding lots of people with old tickets and Vermont shows that you got a ticket in 1986 and paid it in 1988 but since you waited so long to pay it your Vermont drivers lic. had been suspended and you never paid the reinstatement fee - which was $25 but now with interest and stuff is $95 and you need to take care of that before I can give you your new license.

all right, so I sit and think about this & it comes back to me... I did get a ticket in PA in 1986 with a Vermont license while in the military - I never paid it and PA sent me a note 6 months later saying I can never drive there again... ok - then a year later Vermont sends me a note saying I can't driver there ever again either... ok, I wasn't wanting to go back anyway.. I never did pay any of it but maybe my mom did or something I'll have to ask her someday cause I had a California license and was young and dumb and just plain didn't care - plus I thought I was getting over on them and it was a really stupid ticket anyway...
so I call the Vermont DMV, she puts the $95 on my credit card and clears my record & now I can finally sleep at nite knowing this big weight has been lifted - woot!! she also tells me that there is no statute of limitations and she is getting calls from people with unpaid tickets from the 1960s!! so I go back to the CA DMV, wait again and then have to pay them $18 for my duplicate copy...
moral - you can run but you can't hide!!

WRR is right though. In order to fight you gotta pay your bail up front. It really does suck, but if you win and you get that money back you're stoked! It happened to me... but only once (for 350+ bucks too!)

Jack, when I moved to CA, I had the exact same thing happen with an old VT ticket that I thought I had 'escaped' LOL

Before you pay your speeding ticket, request Engineering & Traffic Survey that justifies the posted speed limit. If it doesn't, you can easily win the case, all by mail, so called trial by written declaration.

That's the whole point....you don't get the survey...you request it (you have the right to), if they happen to have it...well, you're kind of screwed, but if they don't.....case dismissed.
you said yourself the road was being assesed as a 45 or 55mph zone...that's the whole point of the survey.
at least, that the point from the links/stories. It'll be interesting to see.
